Spellgs (spellgs.com) is operated by Arcanum LLC ("we", "us"). By using the site you agree to these terms. They're short on purpose. If you don't agree, please don't use the site.

Using the site

Spellgs is free for personal use: finding stores and Commander nights, and sharing links to our pages.
Please don't misuse it. That means no spam, fake submissions or reports, attempts to break or overload the site, getting around our rate limits, or pretending to be a store or someone else.
Don't copy the site's content in bulk (for example by automated scraping) to republish it or build a competing database without our written permission. Linking to us and quoting small parts with credit is fine.
We can change, pause or remove any part of the site, and we can block access for anyone who breaks these terms.

Content you send us

Store submissions, claims, player reports, photos and store responses must follow our Content Policy.
You keep ownership of what you send. You give Arcanum LLC (Spellgs) a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce and format it (for example resizing photos or showing report answers as tags), on Spellgs and on our companion site Spellpods, and in our newsletter, for as long as it's on the service. You can ask us to remove it, and the license ends when we do (except for copies in routine backups).
You confirm you have the right to send it. For photos, that means you took them or have permission from the person who did, and they're of your store.
We review content before it's published and may decline, remove or stop showing anything at our discretion, as described in the Content Policy. We don't edit the words in player reports.

Accuracy: please call ahead

We work hard to cite sources for store details, event times and policy tags, but stores change hours, cancel events and update policies without telling us. Everything on Spellgs is provided for information only and may be out of date or wrong. Check with the store (call, or look at its website or Discord) before you travel, especially for a long drive. Player reports are opinions of individual players, not statements by Spellgs. Our "Best Commander stores" lists rank how well a store is documented, not its quality; see the methodology.

Spellgs is unofficial Fan Content permitted under the Wizards of the Coast Fan Content Policy. Not approved or endorsed by Wizards. Portions of the materials used are property of Wizards of the Coast. ©Wizards of the Coast LLC. Magic: The Gathering, Commander and Wizards Play Network are trademarks of Wizards of the Coast LLC. Store names and logos belong to their owners. A store being listed doesn't mean it endorses Spellgs.

Copyright and takedowns (DMCA)

If you believe something on Spellgs or Spellpods infringes your copyright, send a notice to our designated agent. The fastest way is the copyright notice form, which asks for everything below. You can also send it by mail:

Your notice must include:

your name, address, phone and email;
the work you say is infringed;
the exact page URL and the material on it;
a statement that you have a good-faith belief the use isn't authorized by the owner, its agent or the law;
a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorized to act for the owner;
your physical or electronic signature.

We'll remove or disable the material promptly and let the person who posted it know. If you posted it and believe it was removed by mistake, you can send a counter-notice to the same agent with your name, address and phone, the removed material and where it was, a statement under penalty of perjury that you believe it was removed by mistake, consent to the jurisdiction of the federal court for your district (or, if you're outside the US, any district where Spellgs may be found), and your signature. We may restore the material in 10–14 business days unless the claimant tells us they've filed a lawsuit. We remove content from people who repeatedly infringe. Store owners can also ask us to remove a photo of their store for any reason.

Other sites

We link to store websites, Discord servers, maps and other sites we don't control and aren't responsible for.

No warranty

Spellgs is provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, availability, merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent the law allows, Arcanum LLC, Spellgs and the people who run them aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or travel costs, arising from your use of the site or anything on it (including inaccurate listings, event changes or content posted by others). Our total liability for any claim relating to the site is limited to US $50. Some places don't allow these limits, so they may not all apply to you.

If you use the site in a way that breaks these terms or the law and that causes a claim against us, you agree to cover our reasonable costs of that claim.

Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Miami-Dade County, Florida, and you and we agree to that jurisdiction. If any part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't a waiver of it.

Changes and contact
